Communiqué

Against the background of the briefing presented, on Wednesday,  by the Personal Envoy of the UN Secretary-General for Western Sahara, Mr Staffan de Mistura, during the closed consultations of the UN Security Council, the Frente POLISARIO indicates that the Sahrawi party categorically and decisively informed the Personal Envoy, during his visit on 3 October 2024, that it does not even accept to discuss any proposal or idea, partition or otherwise, which is outside the legal framework of the Western Sahara question, and is contrary to the mandate of the United Nations Mission for the Referendum in Western Sahara (MINURSO), which sets the parameters for the Personal Envoy’s mission.

The Frente POLISARIO recalls that Morocco, the occupying state, following its military invasion of Western Sahara on 31 October 1975, partitioned the Territory of Western Sahara with Mauritania on 14 April 1976, in flagrant violation of the principles of international law and the international status and territorial integrity of Western Sahara as a Territory awaiting decolonisation.

Recalling the international status of Western Sahara as a Territory awaiting decolonisation, which is supported by a legal arsenal of the United Nations, the African Union and other international organisations, the most recent manifestation of which is the ruling of the European Court of Justice issued earlier this month, the Frente POLISARIO strongly affirms the total and categorical rejection by the Sahrawi party of any “proposals” or “initiatives”, regardless of the origin thereof, which do not fully enshrine and ensure the inalienable, non-negotiable and imprescriptible right of the Sahrawi people to self-determination and independence or do not respect the territorial integrity of Western Sahara.

Recalling that Morocco has set preconditions that are totally contrary to any serious and sincere approach to resolve the conflict and to the request of the UN Security Council, the Frente POLISARIO reaffirms the readiness of the Sahrawi party to cooperate with the United Nations and the African Union with a view to achieving a peaceful and just solution to the conflict between the Sahrawi Republic (SADR) and the Kingdom of Morocco based on respect for the UN Charter and resolutions and the objectives and principles of the Constitutive Act of the African Union.

Recalling further the failure of all previous approaches that attempted to circumvent the legal status of Western Sahara and to override the sacrosanct right to self-determination, the Frente POLISARIO affirms the strong determination of the Sahrawi people to continue and intensify their liberation struggle by all legitimate means, including armed struggle, to attain their non-negotiable goals of freedom, independence and the reestablishment of sovereignty over the entire Territory of the Sahrawi Arab Democratic Republic (SADR).
