CJEU sets September 29 as the date for the pronouncement of its rulings on the appeals filed by the Frente POLISARIO

Brussels, September 08, 2021 (sps) - The Court of Justice of the European Union will rule on September 29 at 11 a.m. through two judgments on the legality of the new EU-Morocco agreements.
In December 2016, through a judgment of great importance, the Court of Justice of the Union declared that the EU-Morocco Association Agreement does not apply to Western Sahara, since the Saharawi territory has a different and separate status from the Kingdom of Morocco , and that the Saharawi people had not given their consent to the application of this agreement to their national territory.
Through a series of three judgments handed down in 2018 and 2019, the European courts generalized this solution to all the EU-Morocco agreements, excluding Western Sahara from the scope of the fisheries agreement and the EU-Morocco aviation agreement. It was the end of "the de facto application."
However, departing from the healthy path opened by the Court, the European Commission, under the influence of France, negotiated two new agreements with the Kingdom of Morocco - an agricultural agreement and a fisheries agreement - explicitly including the area under Moroccan occupation of the Western Sahara, highlighting alleged "consultations" with the Moroccan occupier and settlers
In response, the Frente POLISARIO filed two annulment appeals against the decisions of the EU Council to approve these illegal agreements, concluded in violation of the right to self-determination, when the only thing that counts is the consent of the Saharawi people.
On March 2 and 3, 2021, the European Union Court dedicated two days of hearing to an extensive debate on all aspects of the file.
On September 29, 2021, at 11 a.m., the Court of the European Union will issue two judgments on the legality of the Agricultural Agreement and the Fisheries Agreement.
Mr. Oubi Bouchraya, member of the National Secretariat of the POLISARIO Front in charge of Europe and the European Union, declared: «Since its creation, the POLISARIO has always based the national liberation struggle of the Saharawi people on the respect of international law as condition to guarantee peace in the world. The Saharawi people await the judgments of the Court with the greatest serenity.SPS
